Terms of Service
Effective 30 October 2026
These terms are an agreement between Valitura ("we", "us") and the organisation that signs up for Akesis by Valitura at akesis.app (the "Service"), and the people it lets use it ("you"). By creating an organisation or using the Service you agree to them. If you accept on behalf of an organisation, you confirm you have authority to bind it.
1. The Service
Akesis reads the vulnerability findings from your scanners and code hosts, merges and re-scores them, and helps fix them: it adopts fix pull requests from tools such as Dependabot, Snyk and Renovate, can open its own, and, only where your policies allow, merges them and watches for regressions. It is intended for business use only.
2. Accounts and access
- People sign in through your organisation's identity provider. You are responsible for who you give access to, for their roles, and for activity under your organisation.
- Keep your identity provider, the tokens you create for Akesis and the keys it gives you secure. Tell us promptly at security@akesis.app if you suspect unauthorised access.
- You decide which repositories, scanners and other services to connect, and you can disconnect them at any time.
3. Automated changes are yours to govern
Akesis changes code only through pull requests on the repositories you connect, and merges a change only when the autonomy policy you set for that repository allows it and every check Akesis applies passes. You remain responsible for:
- the policies you set, including granting automatic merging, and for keeping a test suite and branch protection that can catch a bad change;
- reviewing changes that Akesis leaves for a person, and the changes your team merges; and
- your code, your systems and the consequences of running them.
Passing tests don't prove a fix is correct. Risk scores, reachability verdicts, AI narratives and suggested fixes are aids to your judgement, not guarantees, and they are not security, legal or other professional advice. You can stop all automation at once with the emergency stop.
4. Your content
You own the information you and your connected services put into the Service ("Customer Content"), including findings, repository and pull request data, policies and the audit log. You grant us a limited licence to host, process, transmit and display it only as needed to provide, secure and support the Service.
You are responsible for having the rights and permissions needed to connect your services and give us Customer Content. How we handle personal information is described in our Privacy Policy. Our Data Processing Agreement forms part of these terms and applies to personal data we process on your behalf.
We don't use Customer Content or your source code to train AI models, and we don't sell it.
5. Acceptable use
You agree not to:
- use the Service unlawfully, or to infringe anyone's rights;
- connect repositories or services you aren't authorised to connect;
- attempt to disrupt, probe or bypass the security of the Service, or to access another organisation's data;
- share access outside your organisation, resell the Service or build a competing product from it; or
- put special categories of personal data, or other regulated data you have no authority to process, into the Service.
To report a security issue in the Service, write to security@akesis.app.
6. Fees
Fees, the plan and the term are set out in your order or agreement with us. Unless it says otherwise, fees are payable in advance, exclusive of taxes, and non-refundable except where the law requires. We will give notice before changing the fees for a renewal. Access provided free of charge, for example to design partners, can be changed or ended on reasonable notice.
7. Third-party services
The Service works with services you choose, such as GitHub, GitLab, Bitbucket, Snyk, Jira, Slack, Sentry, your identity provider and AI assistants. Your use of them is subject to their terms, and they aren't our sub-processors. We aren't responsible for them.
8. Our intellectual property
We and our licensors own the Service, including its software and content. Subject to these terms, we grant you a limited, non-exclusive, non-transferable right to use it during your subscription. Pull requests and other changes Akesis makes to your repositories are yours. If you give us feedback, we may use it without restriction.
9. Availability and support
We work to keep the Service available and monitor it continuously, but we don't promise uninterrupted or error-free operation. Service levels apply only if stated in a written agreement.
10. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these terms, if the law requires it, or to protect the Service or other customers.
When your subscription ends, we cut access, disconnect your integrations, give you a full export of your data and the audit log, and then delete your data within 30 days of you confirming the export, as described in Leaving Akesis and our Privacy Policy. Sections that by their nature should survive will survive.
11. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
12. Limitation of liability
To the fullest extent permitted by law, neither party will be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability arising out of these terms or the Service will not exceed the amounts you paid us in the twelve months before the event giving rise to the claim. Nothing in these terms limits liability that cannot be limited by law.
13. Indemnification
You will defend and indemnify us against third-party claims arising from Customer Content, from your use of the Service in breach of these terms, or from changes you or your policies allowed into your systems, and pay resulting damages, costs and reasonable attorneys' fees, provided we give you prompt notice and reasonable cooperation.
14. Governing law and disputes
These terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. Any dispute will be brought exclusively in the state and federal courts located in Miami-Dade County, Florida, and each party consents to that jurisdiction and venue.
15. Changes to these terms
We may update these terms. If changes are material we will tell your organisation's admins by email or in the Service before they take effect. Continued use after the effective date means you accept them.
16. General
These terms, together with the Privacy Policy, the Data Processing Agreement and any written order or agreement, are the entire agreement between us about the Service. A signed agreement prevails over these terms if they conflict. If a provision is unenforceable, the rest remains in effect. You may not assign these terms without our consent; we may assign them in connection with a merger or sale of our business. Failure to enforce a provision is not a waiver.
